Important Information Concerning Procedures for Opening a New Account: To help the government fight the funding of terrorism and money laundering activities, federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means for you: When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver’s license or other identifying documents. We will make a copy of these identifying documents for our records.

Throughout this Funds Availability Policy, the words “you,” “your,” and “yours” mean each and all of those (whether one or more persons) who are subject to the Funds Availability Policy. The words “we,” “us,” or “Credit Union” mean NCPD Federal Credit Union. This Funds Availability Policy provides the rules regarding when NCPD Federal Credit Union makes funds deposited into your “transaction accounts” and share savings accounts at the Credit Union available. A “transaction account” is an account from which an account holder is permitted to make transfers or withdrawals by negotiable or transferable instrument, payment order of withdrawal, telephone transfer, or other similar device for the purpose of making payments or transfers to third persons or others or from which the depositor may make third-party payments at an automated teller machine (“ATM”) or a remote service unit, or other electronic device, including by debit card; your share draft accounts with us are transaction accounts. The Funds Availability Policy is subject to change upon thirty (30) days’ written notice.

Section I. Your Ability to Withdraw Funds

  • Except as set forth below, our policy is to make funds from your cash and check deposits available to you on the first (1st) business day after the day we receive your deposit. Electronic direct deposits will be available on the day we receive the deposit. Once they are available, you can withdraw the funds in cash, and we will use the funds to pay checks that you have written.
  • For determining the availability of your deposits, every day is a business day, except Saturdays, Sundays, and federal holidays. If you make a deposit before closing on a business day that we are open, we will consider that day to be the day of your deposit. However, if you make a deposit after closing or on a day we are not open, we will consider that the deposit was made on the next business day we are open.
  • With respect to checks deposited through our e-Deposit service, please refer to the Remote Deposit Capture Agreement for information regarding availability of those deposits.

Section II. Longer Delays May Apply

  • In some cases, we will not make all of the funds that you deposit by check available to you on the first business day after the day of your deposit. Depending on the type of check that you deposit, funds may not be available until the second business day after the day of your deposit. The first $225 of your deposits, however, will be available on the first business day after the day of your deposit.
  • If we are not going to make all of the funds from your deposit available on the first business day after the day of your deposit, we will notify you at the time you make your deposit. We will also tell you when the funds will be available. If your deposit is not made directly to one of our employees, or if we decide to take this action after you have left the premises, we will mail or otherwise provide you the notice by the day after we receive your deposit.
  • If you need the funds from a deposit right away, you should ask us when the funds will be available.
  • Case-by-case delays: In addition, funds you deposit by check may be delayed for a longer period under the following circumstances:
    1. We believe a check you deposit will not be paid.
    2. You deposit check(s) totaling more than $5,525 on any one day.
    3. You redeposit a check that has been returned unpaid.
    4. You have overdrawn your account repeatedly in the last six months.
    5. There is an emergency, such as failure of computer or communications equipment.

We will notify you if we delay your ability to withdraw funds for any of these reasons, and we will tell you when the funds will be available. They will generally be available no later than the seventh business day after the day of your deposit.

Section III. Special Rules for New Accounts

If you are a new member, the following special rules will apply during the first thirty (30) days your account is open.

  • Funds from electronic direct deposits to your account will be available on the day we receive the deposit. Funds from deposits of cash, wire transfers, and the first $5,525 of a day’s total deposits of cashier’s, certified, teller’s, traveler’s, and federal, state, and local government checks will be available on the first business day after the day of your deposit if the deposit meets certain conditions. For example, the checks must be payable to you, (and you may have to use a special deposit slip). The excess over $5,525 will be available on the ninth business day after the day of your deposit. If your deposit(s) of these checks (other than a U.S. Treasury check) are not made in person to one of our employees, the first $5,525 will not be available until the second business day after the day of your deposit.
  • Funds from all other check deposits will be available on the eleventh business day after the day of your deposit.

Section IV. Holds on Other Funds

  • If we do accept for deposit a check that is drawn on another financial institution, we may make funds from the deposit available for withdrawal immediately but delay your availability to withdraw a corresponding amount of funds that you have on deposit in another account with us. Those funds in the other account would then not be available for withdrawal until the time periods that are described elsewhere in this Funds Availability Policy for the type of check that you deposited.

Section V. Deposits at ATMs and Shared Branches

  • Deposits at Credit Union Proprietary ATMs. If you make a deposit at ATMs owned and operated by the Credit Union (“proprietary ATMs”), the first $225 of daily aggregate deposits will be available on the first business day after the day of your deposit, and deposits in excess of $225 may not be available until the second business day after the day of your deposit. For daily aggregate check deposits in excess of $5,525 at proprietary ATMs, longer hold periods may apply.
    If you make a deposit at an ATM before 3:00 p.m. (Eastern) on a business day that we are open, we will consider that day to be the day of your deposit. However, if you make a deposit at an ATM after 3:00 p.m. (Eastern) or on a day we are not open, we will consider that the deposit was made on the next business day we are open.
  • Shared Branches. As a member of the Credit Union, you have access to shared branches, which allows you to conduct transactions on your Credit Union accounts, including making deposits, at another credit union that is part of the shared branch network. If you make a deposit at a shared branch on a business day that we are open, we will consider that day to be the day of your deposit. However, if you make a deposit at a shared branch on a day we are not open, we will consider that the deposit to have been made on the next business day we are open.
    If you make a deposit at a shared branch, the first $225 of daily aggregate deposits will be available on the first business day after the day of your deposit, and deposits in excess of $225 may not be available until the second business day after the day of your deposit. For daily aggregate check deposits in excess of $5,525 at shared branches, longer hold periods may apply.

NCPD Federal Credit Union, together with its subsidiaries and affiliates (collectively, “NCPD FCU”, “we”, “us” or “our”), strives to serve your needs and to protect your identity and any information we collect about you when you visit our website or use any other digital services offered by NCPD Federal Credit Union that link to or reference the notice (collectively, our “digital services”). This notice covers many digital services, including the NCPD Federal Credit Union mobile apps, and NCPD Federal Credit Union social media sites or pages, as well as any interactions you may have while viewing our website and links provided through one of NCPD Federal Credit Union’s digital advertising campaigns.

As you review the Digital and Mobile Privacy Notice, here are a few general principles to keep in mind:

Our Online Privacy Policy:

  • Covers your interaction with NCPD Federal Credit Union, its subsidiaries and affiliates, and companies engaged by NCPD Federal Credit Union and its subsidiaries and affiliates to render services (“Service Providers”) when you use any mobile application or visit any website that we own, or visit other sites where we have indicated our policy expressly applies, including, but not limited to, our website (ncpdfcu.org) and our mobile apps (collectively, “Sites”);
  • Describes the categories of personal information that we may collect about you when you interact with or visit our Sites;
  • Discloses whether other parties may collect personal information about your online activities over time and across different websites when you use our Sites;
  • Discloses if we engage in the collection of your personal information about your online activities over time and across different websites;
  • States how we may use information that we collect;
  • Describes the categories of other persons or entities with whom we may share your personal information;
  • Describes the way you can review and request changes to certain personal information that we collect;
  • Discloses how we may respond to web browser “do not track” signals or other opt-out mechanisms;
  • States that we do not knowingly collect personal information of children under the age of 13 without the consent of their parent or legal guardian;
  • Provides a California-specific description of consumers’ privacy rights; and
  • Describes how we will inform you of important changes to our Privacy Policy.

What Information Do We Collect?
We take your privacy seriously and make the safeguarding of your personal information a priority. We collect personal information in accordance with applicable law. If you seek, apply for, or obtain a financial product or service with us, we will use and share that information we collect from or about you in accordance with our Privacy Policy.

We may also collect personal information when you use our sites, products, and services. Personal information that we collect may include your name or other online identifier, home or other physical address, telephone number, email address, IP address, website interactions, geolocation, device identifier, keystrokes, the contents of your communications with us, and information from a consumer report about you. We may also collect Social Security numbers (SSN), driver’s license numbers (or comparable) when you provide such information while using our digital services and where we believe it is reasonably required for ordinary business purposes. Collection may include other information that you provide us with, including, but not limited to, information provided when receiving technical/account setup support.

Additionally, use of the internet makes it possible for us or other parties to collect data about your online activities over time and across different websites, including when you use our Sites. In that regard, we use tracking technology on our Sites that collects analytics, records how you interact with our Sites, or allows us to participate in behavior-based targeted advertising.

How We Disclose Your Information
We do not sell or lease your Personal Information to any third party. We may disclose your Personal Information to a third party for business purposes. We may disclose your Personal Information for a business purpose to the following categories of third parties:

  • Our Affiliates. We may share the information collected through the website with our affiliates.
  • Third-Party Service Providers. We share Personal Information collected through the website with third-party service providers that act for or on behalf of the NCPD FCU. For example, we may use third-party vendors to design, operate, and/or host our website, to conduct surveys, to help us with our marketing and promotional efforts (including targeted advertising), fulfill orders, and to bill users for goods and services. These third parties may need information about you to perform their functions.
  • With Other Carefully Selected Business Partners. From time to time, we may share your Personal Information with selected third parties (other than our service providers). For example, we partner with third parties to sponsor contests or other promotions, and we may share with these third parties the Personal Information you submit to us to participate in the contest or take advantage of the promotion. Before doing so, however, we may offer you the opportunity to “opt out” or “opt in” as required by applicable law.
  • With Third-Party Social Media Platforms. We may provide functionality on the website that allows you to automatically post information to a third-party social media platforms (such as Facebook, Twitter, LinkedIn, or Instagram). If you choose to take advantage of this functionality, people who can view your profile on the third-party platform will be able to see your post. Thus, you should have no expectation of privacy in those actions.
  • In Aggregate or Deidentified Form. We use information collected through the website to create a compiled, aggregate view of usage patterns. We may share aggregate information with third parties so we and they can better understand our user base.

Except as described in this Policy, we will not share your information with third parties without your notice and consent, unless it is under one of the following circumstances:

  • Legal Reasons.
    • We believe that disclosure is reasonably necessary to comply with any applicable law, regulation, subpoena, or court order;
    • To respond to duly authorized information requests from law enforcement or other governmental authorities;
    • To enforce our agreements or policies;
    • To investigate and prevent security threats, fraud, or other malicious activity; or
    • To respond to an emergency that we believe in good faith requires us to disclose such information to assist in preventing the death or serious bodily injury of any person or company employee.
  • Sale of Business or Merger. There are circumstances where NCPD Federal Credit Union may decide to buy, sell, or reorganize its business. Under these circumstances, it may be necessary to share or receive Personal Information with prospective or actual partners or affiliates. In such circumstances, NCPD Federal Credit Union will ensure your information is used in accordance with this Policy.

How Do We Use Information That We Collect?
We may use your personal information to provide and improve our products and services; to process transactions and payments; to conduct analytics and research; to enhance your experience on our Sites; to help deliver our ads on your web browser; to measure advertising campaign effectiveness; to respond to your requests and communications; to manage your preferences; as required to meet legal and regulatory obligations; and for any other purposes that we may specifically disclose at the time we collect or you provide your information. We do not sell your personal information.

In some circumstances, we may anonymize or deidentify your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you. To the extent we maintain and use personal information in an anonymized or deidentified form, we will not attempt to reidentify the information, except for the purpose of determining whether our anonymization/deidentification processes satisfy our legal obligations.

With Whom Do We Share the Information We Collect?
We may share the information we collect from you in the following circumstances:

  • Affiliates and Acquisitions: We may share information with our corporate affiliates (e.g., subsidiaries or other companies under common control) to deliver our products and services to you and for other everyday business purposes in accordance with the practices set forth in our Privacy Policy. If another company acquires, or plans to acquire, our company, business, or assets, we will also share information with that company, including at the negotiation stage.
  • Service Providers: We may share your information with Service Providers. Among other things, Service Providers may help us to administer our website, conduct surveys, provide technical support, process payments, and assist in the fulfillment of services.
  • Legal Obligations: We may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws. We may also share your information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with your request for the shipment of products to or the provision of services by a third-party intermediary.
  • Other Third Parties with Your Consent: We may disclose your information to other third parties when we have your consent or directions to do so. For example, you may authorize some third-party companies to access your information to provide financial products and services such as: account aggregation (consolidating your financial account information from different sources), making payments via a website or mobile application, and tax preparation. We recommend you use caution when granting such access and ensure that these third parties have appropriate policies and practices in place to secure your information. NCPD Federal Credit Union is not responsible for the use or disclosure of any information accessed by or on behalf of any third party or person to whom you provide your NCPD Federal Credit Union sign-in credentials or account information. Any use of your information is governed by the privacy policy and any terms of use with that third party. NCPD Federal Credit Union does not control the privacy, security, or accuracy of your information that may be held by these third parties, and our privacy, security, and other terms will not apply to any third-party services. To disable a third-party service, you will need to notify NCPD FCU either by calling or writing to us. By forgoing and disabling one service, it could impact other services you may have linked. For security and other reasons, NCPD Federal Credit Union may block or disable third-party access to any account without notice.

How You Can Control Your Information
Our Sites are designed for optimal viewing with cookies enabled (cookies are small text files that collect internet traffic data). For example, cookies store your preferences for when you visit our Sites. If your web browser settings allow cookies, our Sites will utilize them. You may disable or remove cookies by accessing your web browser settings. Our Sites will still function without cookies, but some features may not work properly. Please note that due to a lack of consistent standards across browsers, our Sites may not respond to “do not track” browser settings.

We only use your personal information for certain purposes allowed by law (refer to our Privacy Policy), which you cannot limit.

Children’s Online Privacy Protection Act (COPPA)
The Federal Trade Commission adopted a regulation (16 CFR 312) to implement the Children’s Online Privacy Protection Act (COPPA), which governs the collection and use and/or disclosure of personal information from and about children on the internet. NCPD Federal Credit Union does not purposely or knowingly collect personal information from individuals under the age of 13 on any financial institution website by either requesting that children make personal information publicly available, enabling children to make personal information available or through the passive tracking of use of any identifying code linked to an individual. We will not obtain any information from individuals under the age of 13 without the consent of a parent or legal guardian.

Security
We use reasonable physical, electronic, and procedural safeguards that comply with federal standards to protect and limit access to personal information. This includes device safeguards and secured files and buildings.

Please note that information you send to us electronically may not be secure when it is transmitted to us. We recommend that you do not use unsecured channels to communicate sensitive or confidential information (such as your SSN) to us.

Updating Your Information
It is important that we have accurate and up-to-date information about you. If you notice that your information is incomplete, inaccurate, or out of date, you can update your information through our mobile or online service or by contacting us. You may review or update certain account information by logging in and accessing your account(s). Consumer Rights

You have the right to request that we disclose certain information to you about our collection, use and disclosure of your Personal Information over the past twelve (12) months, and no more than twice in any 12-month period. Any disclosures we provide will only cover the 12-month period preceding the receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
  • Correction. You can correct what personal data our website database currently contains by accessing your account directly, or by contacting us to request that we correct or rectify any personal data that you have provided to us.
  • Limit Use and Disclosure of Sensitive Personal Information. If we collect any sensitive personal information, you have the right to request that we limit the use of the sensitive personal information to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services.
  • Portability. Upon request and when possible, we can provide you with copies of your Personal Information. When such a request cannot be honored, we will advise you accordingly. You can then choose to exercise any other rights under this Disclosure.
  • Deletion. You have the right to request that we delete any of your Personal Information from the website database, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies. Responding to Your Request

Upon receiving your request, we will confirm receipt of your request by sending you an email confirming receipt. To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to your Personal Information. In some instances, such as a request to delete personal information, we may first separately confirm that you would like us to in fact delete your Personal Information before acting on your request.

We will respond to your request within forty-five (45) days. If we require more time, we will inform you of the reason and extension period in writing.

In some cases, our ability to uphold these rights for you may depend upon our obligations to process Personal Information for security, safety, fraud prevention reasons, compliance with regulatory or legal requirements, or because processing is necessary to deliver the services you have requested. Where this is the case, we will inform you of specific details in response to your request.
